 A client who previously sued Discovery Insure for R675,000 now finds themselves liable to pay an amount of R1.7 million.

In November 2016, Tshamunwe Masindi's house in Pretoria suffered severe damage due to a storm. Fortunately, Masindi had insurance coverage for such unforeseen events, and over the next five months, Discovery Insure fulfilled their obligation by paying nearly R1.6 million in total.

This payout proved to be a valuable return on Masindi's insurance policy, considering he had only been paying premiums for six months. The coverage included funds for repairs as well as an amount of R675,000 designated for emergency accommodation while the damage was being addressed. However, it was later revealed that the emergency accommodation claim had been tainted by what the Supreme Court of Appeal recently deemed as "undisputed fraud."

Tshamunwe Masindi experienced relatively minor storm damage, valued at just under R1 million, to his residence in Pretoria. The expenses incurred were covered by Discovery Insure. Additionally, he made a claim for emergency accommodation expenses amounting to R675,000, which was deemed to be fraudulent.

When Discovery Insure requested the reimbursement of the claimed amount, Masindi decided to contest the matter in court and initially emerged victorious. However, the Supreme Court of Appeal later overturned his win, resulting in Masindi losing out on approximately R1.7 million, excluding legal expenses, which he might have otherwise been entitled to.

The fraudulent activities committed by Masindi will now result in a financial loss of approximately R1.7 million. This amount represents the money he would have rightfully retained, without taking into account the legal expenses incurred by Discovery.

The appeals court has rendered a verdict stating that Masindi is obligated to repay the entire claim, along with accrued interest. This ruling comes as a result of the fraud committed by Masindi, overturning a previous decision by the high court, which had stated that he only needed to return the funds allocated for emergency accommodation.

Discovery went to the high court in an attempt to recover all the money it had paid out. This action was based on a common clause found in many insurance contracts that allows for the cancellation of the entire policy retroactively in cases involving fraud. The purpose of such a clause is to discourage exaggerated claims, especially in a climate where fraudulent insurance claims seem to be increasing without restraint, as noted by the Supreme Court of Appeal.

Although the high court acknowledged the presence of fraud in the claim, it deemed the fraud provision to be a penalty clause, rendering it unenforceable under South African law. Therefore, the court ruled that the legitimate portion of the payout should still be honored.

The appeals court, however, disagreed with this ruling, stating that legally, the moment Masindi submitted a fraudulent claim, his insurance policy was nullified retroactively. Without a valid insurance policy, he was not entitled to any money, and therefore, he was obligated to refund Discovery Insure for the entirety of the payments made prior to the discovery of the fraud.

Due to accrued interest over the past six years, the portion of the claim that could have been legitimate has increased from less than R1 million to over R1.7 million.
